Per the "Regulations on the Application and Use of Motor Vehicle Driving Licenses", any of the following bars a person from applying for a driving license: (1) organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, tremor paralysis, mental illness, dementia, or other neurological diseases that hinder safe driving; (2) drug use or injection within three years, or release from compulsory isolation drug rehabilitation for less than three years, or addiction to long-term use of dependent psychotropic drugs not yet quit; (3) flight after a traffic accident constituting a crime; (4) DUI or drunk driving causing a serious traffic accident constituting a crime; (5) license revoked within five years for DUI or for drunk-driving an operating vehicle; (6) license revoked within ten years for drunk-driving an operating vehicle; (7) license revoked within five years for racing, overloading, speeding, or transporting hazardous chemicals in violation of safety management regulations, constituting a crime; (8) license revoked within ten years due to other traffic violations (other than item 4) causing a major accident constituting a crime; (9) license revoked within two years for other circumstances; (10) license cancelled within three years; (11) within ten years of having caused a traffic accident with major-or-greater responsibility leading to serious injury or death while driving without a license; (12) substituted for someone in a driver's exam within three years; (13) other circumstances stipulated by laws and administrative regulations. Anyone who drove without a license and committed any of items (5) to (8) cannot apply within the prescribed period.
