Per the Regulations on the Application and Use of Motor Vehicle Driving License, a person may not apply for a driving license in any of the following cases: (1) those with organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, tremor paralysis, mental illness, dementia, or other neurological diseases that hinder safe driving; (2) those who have used or injected drugs within three years, or who have been released from compulsory isolation and detoxification for less than three years, or who are addicted to long-term use of dependent psychotropic drugs and have not quit; (3) those who fled after a traffic accident that constitutes a crime; (4) those who drove drunk or after drinking and caused a serious traffic accident constituting a crime; (5) those whose license was revoked within the past five years for drunk driving or for driving a commercial vehicle after drinking; (6) those whose license was revoked less than ten years ago for drunk driving of a commercial vehicle; (7) those whose license was revoked less than five years ago for racing, overloading, speeding, or transporting dangerous chemicals in violation of safety management regulations, where it constitutes a crime; (8) those whose license was revoked less than ten years ago for other traffic management violations (other than item 4) causing a major traffic accident constituting a crime; (9) those whose license was revoked less than two years ago in other situations; (10) those whose license was revoked less than three years ago; (11) those who drove without a license and caused a traffic accident bearing main or full responsibility resulting in serious injury or death less than ten years ago; (12) those who substituted for others in the driving examination within three years; (13) other situations stipulated by laws and administrative regulations. Anyone who drove without a license and committed any of items 5 to 8 may not apply for a driving license within the prescribed period.
