Per Article 76 of the Road Traffic Safety Law of the People's Republic of China, if a motor vehicle causes personal injury, death, or property damage in a traffic accident, the insurance company shall compensate within the compulsory third-party liability insurance limit. For the rest: (1) Between motor vehicles, the at-fault party bears compensation; if both are at fault, they share liability based on their respective faults. (2) Between a motor vehicle and a non-motor vehicle driver or pedestrian, if the latter is not at fault, the motor vehicle bears liability; if there is evidence the latter is at fault, the motor vehicle's liability is reduced based on the degree of fault; if the motor vehicle is not at fault, it bears no more than 10% of the liability. If the loss is caused by intentional collision by the non-motor vehicle driver or pedestrian, the motor vehicle bears no liability.
